Terms & Conditions

Please read these terms carefully before engaging our services, requesting quotes, or utilizing our logistics platforms.

1 Acceptance of Terms

These Terms & Conditions ("Terms") govern your use of the website, software tools, freight tracking systems, and commercial services provided by Duatsung Limited Company and its operational division Duatsung Enterprise ("Duatsung", "we", "us", or "our").

By accessing our website, requesting a service quote, booking a shipment, or entering into a commercial agreement with us, you ("Client", "User", or "Customer") agree to be legally bound by these Terms. If you do not agree, you must refrain from using our platforms or services.

2 Scope of Services

Duatsung is a diversified enterprise operating across North America and West Africa. Our operational divisions include:

Logistics & Freight Forwarding

Domestic US transport, vehicle shipping, ocean container forwarding, and customs clearance.

Civil Works & Construction

Building, infrastructure support, heavy machinery haulage, and general supplies.

Trade & Procurement

Cross-border equipment sourcing, commercial purchasing, and international trade assistance.

Agriculture & Natural Resources

Supply chain support for mining logistics, equipment transportation, and agricultural trade.

3 Quotations, Pricing & Payments

  • • Validity of Quotes: All written price quotations provided via email or website submission are valid for fourteen (14) calendar days unless otherwise specified in writing.
  • • Fluctuations & Surcharges: Freight rates, fuel surcharges, port tariffs, and customs duties are subject to market adjustments prior to formal shipment booking confirmation.
  • • Payment Terms: Invoices must be settled according to agreed contractual payment schedules (e.g., upfront dispatch deposit, balance prior to bill of lading release). Late payments may accrue interest at 1.5% per month or the maximum rate permitted by law.

4 Freight Operations & Customer Obligations

When contracting Duatsung for transportation, shipping, or procurement services:

Accurate Information

Clients must provide complete and accurate descriptions of goods, dimensions, vehicle VINs, weight, and hazardous material classifications.

Customs & Regulatory Compliance

Clients are solely responsible for ensuring that all shipped items comply with US export controls, Ghanaian import regulations, and international trade laws.

Prohibited Goods

Illegal narcotics, unauthorized weapons, contraband, dangerous hazardous waste, and unregistered hazardous materials are strictly prohibited.

5 Intellectual Property Rights

All content, software code, graphic elements, vector brand logos, text, software widgets, and design structures on this website are the exclusive property of Duatsung Limited Company and are protected by international copyright, trademark, and intellectual property laws.

No portion of this site or its assets may be reproduced, modified, distributed, or republished without express prior written consent from Duatsung management.

6 Limitation of Liability & Force Majeure

To the maximum extent permitted by applicable law, Duatsung shall not be liable for any indirect, incidental, consequential, or punitive damages resulting from shipment delays, port strikes, maritime disruptions, or technical server outages.

Force Majeure: Duatsung shall not be held liable for failure or delay in performance caused by acts of God, extreme weather conditions, naval blockades, war, government embargoes, border closures, port congestion, or severe labor disputes beyond our reasonable control.

7 Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Ohio, United States and the laws of the Republic of Ghana, without regard to conflict of law principles.

Any dispute arising from or relating to these Terms or our services shall first be submitted to good-faith commercial negotiation. Unresolved disputes shall be resolved in the competent courts of Ohio, USA or Accra, Ghana, depending on the contracting operational entity.
